Terms of Service for Chem

You must be at least 18 years old to use the Service. By using Chem, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You will comply with these Terms and all applicable laws

Chem is a platform designed to facilitate intentional connections through structured prompts and interactions. The Company does not guarantee:

• Matches
• Compatibility
• Relationship outcomes

We provide the framework. User experiences and outcomes are solely determined by user interaction.

You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities under your account

You may not:

• Impersonate another individual
• Use false or misleading information
• Share or transfer your account

You retain ownership of content you submit, including:

• Profile information
• Prompt responses
• Messages and interactions

By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free license to:

• Use, display, reproduce, and distribute your content within the Service
• Operate, maintain, and improve the platform

You represent that you have all necessary rights to grant this license.

You agree not to:

• Harass, abuse, or harm other users
• Engage in hate speech or discriminatory conduct
• Solicit, scam, or spam users
• Attempt to collect personal or sensitive information
• Use the Service for unlawful purposes

The Company reserves the right to investigate and take action, including suspension or termination.

The Company does not conduct background checks on users. You acknowledge that:

• You are solely responsible for your interactions
• The Company is not responsible for user behavior
• You should exercise caution and good judgment

You can report or block another user from any chat in the app. See our Support page for how.

Certain features require payment. All fees are clearly disclosed before you buy.

Chem Premium is an optional, auto-renewing monthly subscription. Purchases are processed by the Apple App Store or Google Play, and the price is shown in the app before you confirm.

• Your subscription renews automatically each month unless you cancel at least 24 hours before the end of the current period.
• Cancel at any time in your App Store or Google Play subscription settings. You keep Premium until the end of the period you have paid for. Deleting your Chem account does not cancel your subscription.
• Payments are non-refundable except where required by law or by the app store's own policies. Apple and Google process all refunds; the Company cannot issue them directly.
• The Company may modify pricing at any time, with notice as required by the app stores and by law.

All content, branding, and technology associated with Chem are owned by the Company or its licensors. You may not:

• Copy, reproduce, or distribute platform content
• Reverse engineer or attempt to extract source code
• Use the Service for competitive purposes

The Company may:

• Modify, suspend, or discontinue any part of the Service
• Add or remove features at any time

No prior notice is required.

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in harmful or abusive behavior
• Misuse the Service

You may terminate your account at any time, in the app (Account tab > Delete Account) or at chemsparks.com/account-deletion.

The Service is provided “as is” and “as available.” The Company disclaims all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement

We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, the Company is not liable for:

• Indirect, incidental, or consequential damages
• Losses resulting from user interactions
• Emotional, relational, or personal outcomes

Yes, this includes ghosting, bad dates, and questionable decisions.

You agree to indemnify and hold harmless the Company from any claims arising from:

• Your use of the Service
• Your content
• Your interactions with other users

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes arising out of these Terms will be resolved through binding arbitration in California, except where prohibited by law. You waive the right to participate in class actions.

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

These Terms are between you and Static & Sylk LLC only, not Apple or Google. We, not Apple or Google, are responsible for the Service and its content, maintenance, support, and any claims relating to it. Apple and Google have no obligation to provide maintenance or support for the Service.

If you downloaded the app from the Apple App Store: to the extent the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

Your use of the App Store or Google Play is also subject to their own terms.
